In most cases the people who are signing these documents are usually the elderly. It is the responsibility of the notary to determine tactfully that the person who is signing the documents has the ability to understand the situation. This may require a short conversation for the notary to assess the signers ability to make a rational, informed decision. If the signer has difficulty in producing reasonable responses, the notary can decline to officiate. In this case the fee quoted still must be paid to the notary.
Signature by mark is for a person who cannot sign because of a physical disability or illiteracy. There must be two witnesses to also sign the document and one must print the markers name beside the mark.
Everyone signing the documents must provide the notary with a photo id and be logged into the notary record book.
Witness can not be any person who directly benefits from the document
